1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and Finger Pulse ("we", "us", or "our") concerning your access to and use of the Finger Pulse mobile application (the "App").
By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use or access the App.
2. Medical & Health Disclaimer (Critical Notice)
- The App is NOT a certified medical device and should never be used as a replacement for professional medical equipment, diagnosis, clinical evaluation, or treatment.
- Heart rate calculations, HRV analysis, blood oxygen estimates, and stress scores generated via optical photoplethysmography (PPG) are estimations provided solely for general wellness tracking.
- Do not adjust medications, therapies, or healthcare decisions based on values provided by this App without consulting a qualified healthcare professional.
- If you experience chest pain, shortness of breath, dizziness, irregular heartbeat, or any medical emergency, call emergency medical services immediately.
3. Safe Device Usage & Flash Caution
When using the optical measurement feature, your device's camera LED flash may turn on to illuminate the blood vessels in your fingertip:
- LED Temperature: The camera LED flash may become warm during prolonged measurements. If you feel uncomfortable heat, remove your finger immediately.
- Proper Placement: Place your fingertip gently over the rear camera lens without pressing excessively hard, as heavy pressure may restrict local blood flow and reduce reading accuracy.
4. License to Use
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for personal, non-commercial purposes on iOS devices that you own or control.
5. Auto-Renewable VIP Subscriptions & Billing
Finger Pulse offers optional auto-renewable subscription plans ("Finger Pulse Pro" / VIP Membership) that unlock premium features including unlimited pulse measurements, in-depth HRV trends, guided breathing exercises, and an ad-free experience.
- Payment: Payment will be charged to your Apple ID Account at confirmation of purchase.
- Automatic Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours prior to the end of the current billing cycle.
- Renewal Billing: Your account will be charged for renewal within 24 hours before the end of the current period at the rate of the selected plan.
- Managing Subscriptions: You can manage or cancel your subscription at any time by going to your iOS Device Settings > [Your Name / Apple ID] > Subscriptions.
- Free Trials: Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription, where applicable.
- Refunds: Refund requests are managed exclusively by Apple according to Apple Media Services Terms and Conditions.
6. User Content & Local Data
Any health logs, notes, or profile information you enter into the App remain your personal property. The App stores your records locally on your device. You are responsible for safeguarding your device and keeping local backups.
7. Prohibited Conduct
You agree that you will NOT:
- Reverse-engineer, decompile, disassemble, or attempt to extract the source code or proprietary PPG algorithms of the App.
- Use the App for any illegal, unauthorized, or clinical diagnostic purpose.
- Rent, lease, lend, sell, redistribute, or sublicense the App or any part thereof.
- Attempt to bypass or circumvent subscription access restrictions or digital rights management.
8. Intellectual Property Rights
All trademarks, logos, UI designs, code, algorithms, graphics, and software associated with Finger Pulse are the exclusive intellectual property of the App developers. All rights not expressly granted to you are reserved.
9. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF MEASUREMENTS, AND NON-INFRINGEMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE APP DEVELOPERS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, HEALTH COMPLICATIONS, LOSS OF DATA, OR FINANCIAL LOSS ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.
11. Governing Law & Apple Terms
These Terms shall be governed by and construed in accordance with applicable laws. You also acknowledge that these Terms incorporate Apple’s Standard End User License Agreement (EULA) as set forth by Apple Inc.
12. Termination & Changes to Terms
We reserve the right to amend these Terms at any time. Continued use of the App following any modifications constitutes your acceptance of the revised Terms. We may terminate or suspend your access to the App immediately without prior notice if you breach these Terms.
